1. Who we are

The website nostapapia.com is offered by Basmartens.com, gevestigd in Nederland, referred to below as "we" or "the operator". These terms apply to every visitor and user of the website, referred to below as "you" or "the user".

2. What Nos ta papia is and is not

Nos ta papia publishes one question a day with a number of answer options and adds up the votes cast. The outcome is a snapshot of the people taking part at that moment.

• The polls are not representative and are not scientific or statistical research.
• The results say nothing about the population of Curaçao as a whole.
• The website is not a news outlet and does not provide legal, financial, medical or political advice.
• A question or answer option is not a position taken by the operator.

So do not use the results as a basis for decisions that really require expert advice or proper research.

3. Access and availability

We do our best to keep the website available and up to date, but we do not guarantee uninterrupted availability. We may change, temporarily suspend or permanently discontinue the website, the questions, the features or the platform as a whole at any time, without this giving rise to any right to compensation.

4. Rules of use

You use the website in a normal and respectful way. In any event it is not permitted to:

• influence the outcome of a poll using automated means, scripts, bots or by circumventing the protection against double voting;
• vote more than once on the same question, for example by clearing cookies or using different devices or networks;
• overload or scrape the website or copy content unlawfully;
• post content that is discriminatory, threatening, hateful, insulting or otherwise unlawful;
• infringe the rights of others, including privacy and intellectual property;
• use the website for advertising, spam or commercial purposes without our permission.

5. Fair voting

To keep results reliable we use technical measures against double voting. We may remove or exclude votes that in our judgement were not cast fairly. We may also close a poll, restart it or correct the result.

6. User contributions

If the website offers the option to comment or post content, you remain responsible for what you post. You warrant that your contribution does not infringe the rights of others and is not unlawful. You grant us a free, non-exclusive licence to display, store and distribute your contribution on the website to the extent needed to operate the platform.

7. Commercial activities

The operator may generate revenue in various ways, including offering sponsored questions or content, selling advertising space and supplying anonymised data insights and reports to companies, research institutions or government bodies. Individual votes, comments or account data are never linked to third parties without consent.

Sponsored content is presented in a clearly identifiable way. The objectivity of the polls comes first: commercial activities have no influence on the content or outcome of the questions.

8. Moderation and removal

We may refuse, edit or remove content without prior notice and restrict or block a user's access, for example in case of abuse or a well-founded report. We are not obliged to review content in advance. If you come across unlawful content, please report it to info@nostapapia.com. We will assess such a report within a reasonable period.

9. Intellectual property

The name, the logo, the design, the texts, the software and the compilation of the website are owned by the operator or its licensors. You may view and share the content for your own non-commercial use, with a source reference and a link. Reproduction on a larger scale or reuse for commercial purposes is only permitted with our prior written consent.

10. Links to third party websites

The website may contain links to third party websites. We have no control over those websites and are not responsible for their content, their operation or their privacy practices.

11. No warranties

The website and all information on it are provided as they are. We give no warranty whatsoever as to accuracy, completeness, timeliness, fitness for a particular purpose or uninterrupted availability of the website or the results.

12. Liability

To the extent permitted by law, we exclude all liability for damage arising from or connected with the use of the website. This applies in particular to:

• decisions you take on the basis of a result, a question or an answer on the website;
• incorrect, incomplete or manipulated results;
• statements, opinions or contributions by other users;
• the website not being available, not fully available or not available on time;
• loss of data, lost profit, missed savings, reputational harm or other indirect or consequential damage.

Should liability nevertheless be established, it is in all cases limited to direct damage and to a maximum of 250 euro per event, with a maximum of 500 euro per calendar year. The limitations in this article do not apply in the event of intent or wilful recklessness on the part of the operator, nor to the extent that mandatory consumer law prevents them.

13. Indemnity

If you use the website in breach of these terms or of the law, you indemnify the operator against third party claims arising from this, including reasonable legal costs.

14. Changes to these terms

We may amend these terms. The current version is always on this page, with the date of the last change at the top. If you continue to use the website after a change has been published, the new version applies.

15. Governing law and disputes

These terms and any use of the website are governed by Dutch law. Disputes will be submitted to the competent court in the Netherlands, unless mandatory law designates another court. If you are a consumer, you retain the protection offered by the mandatory law of your place of residence.
